… for the Petitioner(s)
Mr. Sayak Chakraborti Ms. Supriti Sarkhel
… for the State-respondent(s)
The petitioner is in custody for more than two years one month. However, there was a direction by the Hon’ble Apex Court in a Special Leave to Appeal (Crl.) Nos. 3483 of 2026, wherein, six months’ time was granted to the prosecution to complete the witnesses. Such order was passed by the Hon’ble Apex Court on 19.03.2026. But, such order was communicated to the learned trial court on 23rd March,
2026. Memo of evidence submitted along with the status report reflect that two witnesses were examined. State opposes the prayer for bail and submits that six witnesses have been examined. 2 Having regard to the fact that some more witnesses are to be examined by the prosecution and one of the independent witnesses have turned hostile, I am of the opinion that the petitioner be released on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Anikul Islam shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Murshidabad without prior permission of the learned Special court/trial court or the court in seisin of the case. Accordingly, CRM (NDPS) 2118 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence and the report submitted by the State be kept with the record.
