Ankit Kumar -vs- The State of West Bengal Mr. Gaurav Dutta Mr. Srinjan Ghosh … for the petitioner This is an application wherein petitioner is aggrieved by the order dated 07.11.2025 passed in NDPS Case No. 02 of 2024 by learned Additional District and Sessions Judge, 3rd Court, Paschim Bardhaman, Asansol. By the impugned order learned court below rejected the petitioner/accused person’s prayer for further examination of P.W.1. While rejecting such prayer learned court below observed that the P.W.1 was cross examined for three days on behalf of all the accused persons and questions were put to him on the procedural lapses as well as on the topography of the alleged P.O. and all the other grounds as mentioned in the petition and thereby the court agreed with the view of the learned Special Public Prosecutor that merely because the supplementary charge sheet was submitted, further cross examination of P.W. 1/ complainant is not necessary. Having heard learned counsel for the petitioner, the application is admitted. Since the order, which is going to be passed by this Court will not cause any prejudice to the other side the service of copy of application upon the opposite party/State is hereby dispensed with. 2 The petitioner before this Court has not placed the questionnaire that he wants to put by way of further cross- examination to the P.W.1. Therefore, the instant application being CRR 593 of 2026 is disposed of giving liberty to the petitioner to frame and file a questionnaire before the court below that he wants to put to the P.W.1 by way of further cross examination, within a period of three weeks from date and on receiving such questionnaire, the court below will decide afresh as to whether further cross examination of P.W. 1 is required for the purpose of adjudication of the said criminal proceeding or not preferably within a period of three weeks thereafter. The impugned order dated 07.11.2025 is interfered to that extent.
