2. Mr. Narayan Dutt, Standing Counsel for the State of Uttarakhand.
3. By means of this writ petition, petitioner has sought the following relief: -
“I. issue a writ or order or direction in the nature of Mandamus commanding and directing respondent authorities to consider the candidature of the petitioner for the post of Assistant Teacher (Elementary-Science stream) in District Bageshwar under the General Category being a higher meritorious candidate than the lower selected/ appointed candidate.”

It is contended on behalf of the petitioner that petitioner did appear in the Office of District Education Officer, Bageshwar for counselling on the scheduled date, however, he was not permitted in the counselling process on the ground that there was slight delay in petitioner reporting for counselling.
5. Learned State Counsel, however points out that petitioner received entire education, including D.El.Ed. from institutions situate in State of U.P. He further submits that D.El.Ed. can be done from State of U.P. by a candidate, who is a permanent resident of that State.
6. Having regard to the relief sought in the writ petition, this Court thinks that ends of justice would be met, if petitioner is permitted to make fresh
2026:UHC:1401 representation to the competent authority, highlighting his grievance.
7. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to the District Education Officer (Elementary), Bageshwar. If he makes representation within ten days from today, decision thereupon shall be taken, as per law, within four weeks thereafter.
