ORDER The Contempt Petition is filed complaining wilful disobedience of the
order dated 06.05.2026 made in W.P.Crl.No.1066 of 2026.
2. Upon a perusal of the order, when the petitioner complained that the Respondents are not ensuring their safety and protection of their personal lives and properties, this Court disposed of the Writ Petition by directing the petitioners to lodge a fresh complaint before the first respondent, namely, Inspector of Police (L&O), Kangeyam Police Station and directed the first respondent to take necessary action in accordance with law, within a period of two weeks from the date of receipt of the copy of the order.
3. Upon hearing the learned counsel on either side, it can be seen that as
directed, the petitioners have lodged a fresh complaint and based on the same, a case in Crime No.282 of 2026 was registered for the alleged offences under Sections 329(3), 296(b), 115(2), 324(2), 126(2) & 351(2) of BNS and after investigation, now, a final report referring the case as a mistake of fact has been filed before the Judicial Magistrate, Kangeyam and the RCS notice bearing No.157 of 2026 is also served on the petitioners. The learned Judicial Magistrate has posted the matter on 25.08.2026 to decide about accepting the final report filed by the Police. https://www.mhc.tn.gov.in/judis

4. In view thereof, it will be very well open to the petitioners to file such protest petition in the manner known to law. The learned counsel would place on record certain photographs and video graphs, which depicts the forceful breaking open of the property. Needless to mention that every piece of evidence that is in command of the petitioners shall also be filed along with the protest petition, which will be duly considered by the learned Magistrate while deciding the protest petition.
