JUSTICE ARUN DEV CHOUDHURY 10.02.2026 (Ashutosh Kumar, CJ) The main writ petitions are yet to be finally decided. However, this Court, vide an interim order dated 21.01.2026 passed in WP(C)
Page No.# 3/4 No.239/2026, had directed that the applicants/writ petitioners shall not be dispossessed from the land in question. For some lack of communication or misunderstanding about the reach of the order, a barricade was put up without affecting the rights of the applicants/writ petitioners. The applicants/writ petitioners have come up before this Court stating that this is only a prelude to dispossession and thus the interim order of this Court has been breached. Mr. R. Borpujari, learned Standing Counsel, Revenue & Disaster Management Department, after taking instructions from the answering respondents, has submitted that there is no intention of breaching the interim order passed by this Court. The rights of the applicants/writ petitioners were not adversely affected by just putting a barricade. However, since the interim order required the respondents not to proceed in any manner so far as the land was concerned, Mr. Borpujari assures that even the barricade which has been put up, shall be removed within a period of 1(one) week from today. With this undertaking of Mr. Borpujari, learned Standing Counsel, Revenue & Disaster Management Department, the grievance of the applicants/writ petitioners stands redressed. There would be no necessity now of continuing with the present interlocutory applications. Accordingly, the Interlocutory Applications stand disposed off.
