Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and has been implicated in connection with the instant case for alleged recovery of 25.311 Kgs. of Ganja. Additionally, it has been submitted that charges have been framed and the prosecution has cited 8 witness in order to prove its case.
Learned advocate for the State opposes the prayer for bail and submits that the witness action would start from the next date fixed. The quantity so seized is of commercial quantity.

Having considered that the petitioner is detained for a year and there is no scope of the trial concluding in near future, further detention of the petitioner is unwarranted.
As such the prayer for bail of the petitioner is allowed. Petitioner, namely, Biranchi Biswal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act cum Learned Additional Sessions Judge, 4th Court, Paschim Medinipur.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Paschim Medinipur without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1728 of 2025 is allowed.
