39. 14.10.2026. Court No.33. (Pritam) (Rejected) IN THE HIGH COURT AT CALCUTTA CRIMINAL MISCELLANEOUS JURISDICTION CRM (M) 2290 of 2026. In Re: An application for Bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kulpi Police Station Case No.449/2024 dated 14.12.2024 under Sections 103(1)/3(5) of the BNS, 2023. In the matter of: - Ananda Dolui. ..…petitioner. Mr. Abdul Aziz Modal. ..…for the petitioner. Mr. Paramananda Sharma, Ld. APP., Mr. Ramashis Mukherjee, Ms. Jayashree Patra. ...for the State. 1. The learned advocate representing the petitioner sought for bail on the ground of parity in connection with another co-accused who has been granted bail by this court on 8th October, 2026 in CRM(M) 2032 of 2026. 2. The learned advocate representing the State opposed the prayer for grant of bail stating overt acts of the present accused person to have been revealed in the statement recorded under Section 183 of the BNSS, 2023. Moreover, the present petitioner is not similarly circumstanced with that of the co-accused person, who has earlier been granted bail as aforesaid. The entire list of vulnerable witnesses had not yet been examined, being the eye- witnesses. 2 3. Considering the narrative in the complaint as well as the statements recorded under Section 183 of the BNSS, the present petitioner had been attributed with specific incriminating materials and the same cannot be claimed to be ‘similarly circumstanced’ with that of the co-accused person and accordingly, the prayer for bail is considered and rejected. 4. The learned advocate for the petitioner may advice the petitioner to renew the prayer for bail after recording of evidence of the entire list of the vulnerable witnesses. 5. Accordingly, the application being CRM(M) No. 2290 of 2026 is dismissed. 6. (Ananya Bandyopadhyay, J.)
