Ms. Priyanka Bhowmik ….for the Petitioner Mr. Avishek Guha Ms. Sonal Agarwal Ms. Anunika Dutta ….for the Respondent No. 3 and 4 It is submitted on behalf of the respondent no. 3 and 4 being the financial institution that they are ready and willing to settle the entire debt at an amount of Rs. 13,00,000/- only in full and final settlement (without prejudice to their rights and contentions). This is unacceptable to the petitioner. In view of the above, there is no question of any settlement. The writ petition is directed against a proceeding initiated under the SARFAESI Act. In view of the statutory alternative remedy available to the petitioner, there are no exceptional reasons as to why any discretion should be exercised in favour of the petitioner, WPA 5103 of 2026 stands dismissed. Liberty is granted to the petitioner to avail of its statutory remedy in accordance with law, if so advised. 2 It is made clear that there has been no expression on the merits of the case and all issues are left open for the Debts Recovery Tribunal to decide in accordance with law.
