For Petitioner(s): Mr.J.Pradeep For Respondent(s): Mr.K.Raja, Standing Counsel for R1 and R2 Order The Writ Petition has been filed seeking to issue a writ of Mandamus to disburse interest at the rate of 6 percent per annum on the belated payment of Provident Fund, Gratuity, Pension Commutation and Earned Leave Surrender benefits, and consequently direct the Respondents to disburse the unsettled benefits towards surrendered Leave Salary and Salary for the last 11 days, within such time as may be stipulated by this Court. https://www.mhc.tn.gov.in/judis WP No. 26198 of 2026 __________ Page3 of 6 2. The case of the petitioner is that he was appointed in the respondent-Transport Corporation on 17.09.1987 and retired as a Selection Grade Senior Driver on 31.03.2019 after rendering unblemished services for 31years. However, the terminal benefits have been settled to the petitioner on 22.09.2019 but no interest has been paid for the delayed period. Therefore, the petitioner had submitted representation to the respondents dated 18.06.2026, requesting them to pay interest for the delayed period. Since the same was not considered, the present writ petition has been filed. 3. The learned Standing Counsel for the respondent would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 4. Heard the learned counsel for both sides and perused the materials available on record. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal https://www.mhc.tn.gov.in/judis WP No. 26198 of 2026 __________ Page4 of 6 benefits of the petitioners and to disburse all the other eligible unsettled terminal benefits due to the petitioner along with interest at the rate of 6% per annum for the delayed period. The respondents are also directed to consider and disburse the petitioner’s salary for the last 11 days of service, if there is no impediment to such disbursal. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. 6. In the result, the Writ Petition is disposed of.
