Sandesh Saravanan For Respondent(s): Mr.S.Siddhartha Vishnu, GA https://www.mhc.tn.gov.in/judis WP No. 24853 of 2026 __________ Page3 of 6 Order This Writ Petition has been filed to direct the 1st respondent to dispose the petitioners’ representation dated 26.05.2026 within a stipulated time frame and further direct the 1st respondent to forbear the 2nd respondent from implementing the resolutions passed in the Special General Meeting held on 17.05.2026, pending disposal of the petitioners’ representation dated 26.05.2026. 2. Petitioners are the members of the second respondent Association. The second respondent conducted Special General Meeting on 17.05.2026 without following proper procedure and bye-laws of the Association, thereby affecting the interest of the members of the second respondent Association. Hence, the petitioners gave a representation to the first respondent on 26.05.2026 seeking immediate cessation of CAM Revision, nullification of non-complaint electronic votes and scheduling of a fresh voting assembly following correct notice procedures. Since the first respondent has not taken any action on the said representation, the petitioners are before this Court. 3. The learned Government Advocate appearing for the respondents would submit that the representation of the petitioners would be considered and appropriate orders would be passed within a time frame fixed by this Court which was agreed to by the learned counsel for the petitioners. https://www.mhc.tn.gov.in/judis WP No. 24853 of 2026 __________ Page4 of 6 4. In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent to consider the representation of the petitioners dated 26.05.2026 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioners and any other interested persons, within a period of two weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the first respondent to consider the representation on its own merits and in accordance with law. 5. Accordingly, the Writ Petition stands disposed of. No costs.
