3. The case of the petitioner, in a nutshell is that the petitioner retired from the post of Senior Poultry Inspector in the year 2001. At the time of his retirement, the petitioner was getting the pay-scale of 6,500-10,500.

The grievance of the petitioner is that pursuant to the Office-Memorandum dated 04.01.2019 issued by the Ministry of Personnel, PG & Pensions (Department of Pension and Pensioners’ Welfare), the persons, who retired prior to implementation of 6th Pay Commission i.e. before 01.01.2006 and were serving on the pay-scale of 6,500-10,500 and were earlier granted grade-pay of 4200, their grade pay was revised and upgraded to
4600.

Learned counsel for the petitioner submits that the benefit of this office- memorandum issued by the Central Government has not been given to the petitioner.

Learned counsel for respondent-State submits that if petitioner makes a fresh
representation in this regard, the same shall be examined by the competent authority.
7. The writ petition is disposed of with liberty to the petitioner to make a fresh representation to the respondent no.2 within two weeks from today. If petitioner makes such a representation, decision thereupon shall be taken within eight weeks from the date of receipt of such representation.
