Learned counsel for the petitioner submits that the petitioner is in custody in connection with Nimiaghat P.S. Case No. 97 of 2025 corresponding to G.R. Case No. 233 of 2026, registered under Sections 191(2), 191(3), 190, 352, 115(2), 118(2), 109(1), 333 and 103(2) of Bharatiya Nyaya Sanhita, 2023, now pending in the court of learned Judicial Magistrate, at Giridih. 3. Learned counsel for the petitioner further submits that the petitioner is in custody since 07.10.2025 and has been falsely implicated in this case. He has also submitted that the petitioner is 72 years of age. 4. Learned counsel for the petitioner has further submitted that the charges have already been framed and the next date has been fixed for evidence of the prosecution. 5. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that there is direct allegation against the petitioner of assaulting the victim, who died of injuries. He has submitted that the petitioner may not be enlarged on bail. 6. After hearing the learned counsel for the parties and considering the direct allegation against the petitioner that the petitioner along with co-accused assaulted the grandmother of the informant by fists and kicks, who ultimately died, this Court is not 2026:JHHC:10570 2 inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 7.
