In Re : Santosh Gupta
... Petitioner.
Mr. Sandip Kumar Bhattacharya, Mr. Dipta Dipak Banerjee, Ms. Srijita Dhar, Ms. Srilekha Dhar
... For the Petitioner.
Mr. Debajyoti Deb, Mr. Chandra Kamal Gupta
... For the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 8 years 8 months and similarly placed accused persons have already been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the fact that some time will be required to take the trial to its logical conclusion. Having considered the same particularly the long incarceration of the present petitioner, I am of the opinion that the present petitioner viz., Santosh Gupta be released on bail by the learned Trial Court on the same terms and conditions as the other accused viz. Md. Babar Khan @ Babar Khan who has been granted bail on 09.07.2026 in CRM (M) 2824 of 2025.
2 Accordingly, the prayer for bail of the petitioner is allowed. The application for bail, being CRM (M) 2650 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
