15.10.2026 Item no.1 Ct. 444 RD IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE
WPA 24229 of 2024
Ramen Sarkar & Ors. VS The State of West Bengal & Ors.
Mr. Probal Sarkar, Ms. Sk. Kiran,
….for the Petitioners
Ms.Jayita Dhar Chakraborty, Mr. Joy Ranjan Dhar, …. For the Respondent
1. Affidavit of service, as filed, be kept with the record.
2. Petitioners are Assistant Teachers under the District Primary School Council, Murshidabad. They are getting ‘A’ Category scale from the date of publication of the result of their training qualification i.e. DEL.ED course.
3. By way of instituting the instant writ petition, petitioners are primarily praying the ‘A’ category scale, which has already been granted them in terms of the memo dated 10th January, 2024, should be given from the date
2 of result declaration of D.EL.ED (online) examination held in March 2019, i.e. 22nd May,
2019.
4. Reliance has been placed upon the judgment and order dated 22.09.2025 passed by the Hon’ble Division Bench of this Court in MAT 1522 of 2024 with FMA 1029 of 2024 with MAT 1524 of 2024, the Additional Secretary to the Government of West Bengal, School Education Department, Elementary Education Branch on 10th January, 2024 observing inter alia that the entitlement to such scale of pay would be with effect from the date of result declaration of D.EL.Ed (Online) examination held in March 2019 i.e., 22nd May, 2019.
5. It is revealed that the identical issue cropped in a batch of writ petition and orders passed in those writ petition challenged in three intra court appeal. The Hon’ble Division Bench by an
order dated 22-09-2025 disposed of those appeals by a single order directing the writ petition shall be granted “A’ category pay-scale with effect from the date of result declaration of DEL.ED (online) examination held in March
3 2019, i.e., 22nd May, 2019 and that the arrears shall be paid to the writ petitioners by 15th December, 2025.”
6. Considering the order dated 22-09-2025 passed by the Hon’ble Division Bench and grievance of writ petitioners in the instant writ petition. I am of the opinion that the writ petition can be disposed of in terms of the
order dated 22.09.2025. Thus, the instant petition is disposed of directing the respondent no. 6 & 8 to pay “A category pay-scale with effect from the date of result declaration of DEL.ED (online) examination held in March 2019, i.e., 22nd May, 2019 and that the arrears shall be paid to the writ petitioners by 15th December, 2025 within a period of 12 weeks from the date of communication of this order”.
