HC-KAR NC: 2026:KHC:1261 WP No. 19833 of 2025 PREFERABLY WITHIN A PERIOD OF THREE MONTHS FROM THE DATE OF SUCH DIRECTION.
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE DR. JUSTICE CHILLAKUR SUMALATHA ORAL ORDER Heard Ms.Anitha S.M., learned counsel for the petitioner. On hearing learned counsel for the petitioner and upon perusal of relevant material that is brought on record, this Court feels that issuance of notice to respondent is not necessary.
2. This writ petition is filed seeking the Court a writ of mandamus directing the Court of III Additional Principal Judge, Family Court, Bangalore, to dispose of MC No.2236/2021 which is pending on the file of the said Court expeditiously.
3.
Learned counsel for the petitioner submits that the petitioner is the wife of the respondent. She filed a petition seeking a decree of dissolution of marriage. The said petition was filed in the year 2021 and the case is still pending. Therefore, the petitioner approached this Court to direct the trial Court to dispose of the case expeditiously.

4. The petitioner filed certified copies of the order sheets which discloses the flow of proceedings. The reasons assigned for adjourning the matter on different occasions are convincing. The daily orders reveal absence of the petitioner/her counsel on different dates. Few to mention are 08.08.2022, 12.09.2022, 22.11.2022, 19.01.2023, 14.03.2023, 27.11.2023 and 21.06.2024. In case the petitioner was pursuing the matter without seeking any adjournments, the relief sought for would have been granted by this Court. However, the daily order sheet reveals that the petitioner is equally to blame for non disposal of the case within time. Also the proceeding sheet reveals that the Court is putting all its efforts for disposal of the matter and the Court has imposed costs whenever it felt that the parties have sought time without sufficient cause. Therefore, this Court is of the view that the writ petition lacks merits. Resultantly, the writ petition stands dismissed. Sd/- (DR.CHILLAKUR SUMALATHA) JUDGE AP CT:TSM List No.: 1 Sl No.: 14
