Sreenivasan For Respondent(s): Ms.D.Varsha Deputy AG & OT Common Order The present application has been instituted seeking a direction to the respondents to lease out the property under the control of the respondent/AG & OT situated at Door No.16, Woods Road, Chennai 600 002, on a monthly rent of Rs.1,79,496/- (Rupees One Lakh Seventy Nine Thousand Four Hundred and Ninety Six only) at Rs.81/- per sq.ft per month for a minimum period of thirty years and Door No.173, Pycrofts Road, Royapettah Chennai 600 002, on a monthly rent of Rs.1,41,480/- (Rupees One Lakh forty one thousand four hundred and eighty only) at Rs.40/- per sq.ft per month for a minimum period of thirty years. (amended vide A.No.2771 of 2026 dated 10.07.2026) 2. High Court, in exercise of its powers, is not expected to entertain such individual applications for leasing out the properties without ascertaining the factual position, including market rental value and other aspects of the matter. 4. These are all the technical and complex nature of issues, which are to be determined with the assistance of Engineers by AG & OT, and only by conducting public auction in a transparent manner, such properties are to be leased out or dealt with. 5. Therefore, this Court directs AG & OT to conduct public auction by ascertaining the market rental value and taking into consideration other aspects of the matter, and by following the procedures as contemplated. However, present application instituted seeking a direction to lease out the properties if granted, would cause prejudice to the interest of the trust properties.
