Upon considering the allegations in the FIR, it can be seen that the son of the de facto complainant was involved in the construction work. While so, he fell down from the scaffolding and was seriously injured and is undergoing protracted treatment. 3. The contention of the parties is that the petitioner/accused No.5 is not the principal employer or the employer. The petitioner is only a manpower agent and only supplied man power to the other accused. Even then, it is stated that the accused No.5 has borne Hospital expenses so far and taking care of the injured person. The de facto complainant, who is the father of the injured person, has come before this Court and submitted that only the petitioner alone is taking care of his son so far. Therefore, he does not want to pursue the criminal case as against the petitioner. 4. In view thereof, FIR in Crime No.399 of 2025 shall stand quashed as against the petitioner alone.
