15.10.2026 Court No.35. D/L.02. Rakib (Allowed) CRM (NDPS) 1820 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Uluberia Police Station case no. 434 of 2026 dated 28.06.2026 under Sections 20(b)(ii)(c)/29 of the NDPS Act. And In the matter of : Sk. Mujibar Rahaman ……Petitioner. Mr. Sabir Ahmed Mr. Somopriyo Chowdhury Mr. Shraman Sarkar Mr. Dhiman Banerjee Mr. Quazi Ezaz Ahmed Mr. T. Raja .....for the Petitioner. Mr. R. R. Mohanty ……for the State Learned advocate appearing for the petitioner submits that petitioner after obtaining anticipatory bail in connection with Uluberia Police Station case no. 288 of 2026 and Uluberia Police Station 302 of 2026 surrendered before the learned A.C.J.M. Uluberia. There was a direction for the records to be placed and the petitioner was present at the Uluberia Court compound when the petitioner was arrested. To that effect on 29.06.2026 itself learned advocate took out an application and placed the same before the learned Court. The order dated 29.06.2026 reflects that an application to that effect was furnished before the Court. Learned advocate appearing for the State opposes the prayer for bail as there was allegedly 209.6 kgs of ganja having been 2 recovered from two vehicles and the main accusations was that petitioner had fled away from the spot and was an intending purchaser in respect of the said contraband. Materials placed by the learned advocate appearing for the petitioner reflects that petitioner was arrested on 29.06.2026 and the same is shown in the memorandum of arrest at Uluberia police station compound. Having compared the records of order dated 29.06.2026 of the learned A.C.J.M. Uluberia and the place of arrest reflected in the memorandum of arrest along with the fact that there has been no recovery from the prsent petitioner in the instant case, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. It would not be out of place to state that petitioner was having certain antecedents but there are no other NDPS Act cases pending against the petitioner as has been submitted by the learned advocate for the State as well as the petitioner. Consequently, the petitioner, namely, Sk. Mujibar Rahaman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Uluberia, Howrah. If on bail, the petitioner shall be physically present on each and every date before the learned Jurisdictional Court and shall not 3 leave the jurisdiction of district of Howrah without prior permission of the learned Jurisdictional Court. Additionally, petitioner shall meet with the investigating officer of the case once in a week till the report in final form is submitted before the learned jurisdictional Court. Thus, CRM (NDPS) No. 1820 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Certified copy of the orders of learned 3rd Additional District & Sessions Judge at Howrah be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
