The petitioner has preferred this writ petition under Article 226 of the Constitution of India, seeking following relief(s):- 10.1 That the Hon'ble Court may kindly be pleased to pass an order directing, the Respondent No 02 & 04 to direct the Private Respondent No 05 with regard to the removal of the Encroachment from the Public Road to the petitioner house. BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2026.03.28 10:19:23 +0530 2 10.2 That, the Hon'ble Court direct the Respondent No 03 Commissioner Municipal Corporation to take strict Actions against Respondent No 05 Regarding removal of Illegal Encroachment. 10.3 Any other relief which this Hon'ble Court may deem and proper in the present circumstances of the case. 2. Learned counsel for the petitioner submits that the petitioner has been allotted Permanent Lease under the Government scheme Rajiv Gandhi Ashray Yojna 2002 in respect of land bearing Khasra No.235, area 7 x 12 total 204 sq. ft., situated at Ward No.22, Korba, in which he has constructed a house under the Pradham Mantri Awas Yojna. The land, adjacent to the land of the petitioner, is a Government land used as pathway and drain, but the same has been encroached by respondent No.5 illegally which creates issue of water logging in the walking passage by which the petitioner approaches his house. He further submits that repeated complaints have been made in this regard to the Commissioner, Municipal Corporation, Korba (Annexure- P/5 Colly) and the last complaint is dated 28.8.2025. However, the same has not been decided yet. Hence, it is prayed that this petition may be disposed of at this stage, directing respondent No.3 to decide the application dated 28.8.2025 filed by the petitioner within stipulated period. 3. Learned counsel for the State has no objection if the prayer of the petitioner is allowed. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer of the petitioner, this petition is disposed of at this stage, directing respondent No.3/The Commissioner, Municipal Corporation, Korba (CG) to consider and decide the application 3 dated 28.8.2025 filed by the petitioner, expeditiously, preferably, within a period of 45 days from the date of receipt of a copy of this order. 6.
