DL/49 Ct. No. 758
Mujahid, A.R.(Ct.) In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side
Case No.
WPA 21133 of 2025
In the matter of : Lovely Sarkar … Petitioner VS. The State of West Bengal & Ors. … Respondents
For the petitioner : Mr. Arun Kumar Mohanty Mrs. Kaberi Sengupta Mohanty Mr. R.R. Mohanty Ms. Puspita Chowdhury Ms. Pinki Bala Mr. Debasish Bandhopadhyay … Advocate
1. The grievance of the petitioner is that despite lodging a complaint dated 28th June, 2025 lodged with the Officer-in-Charge Kotwali Police Station, Krishnagar, Nadia by the petitioner no steps were taken by the police. The petitioner, therefore filed the instant writ petition for an order that appropriate FIR must be registered and the cognizable offences complained against the accused person therein be thoroughly investigated. 2. Learned Advocate for the petitioner appears and submits supplementary affidavit affirmed on 13th July, 2026. From the said supplementary affidavit it appears that after filing of the writ petition, Kotwali P.S. Case No. 1020 dated 12th September,
2025 was registered for investigation into the offence punishable under Sections 376, 417, 420 and 506 of IPC. It further appears from the said supplementary affidavit that after registration of the FIR, the police has investigated the case and submitted a charge-sheet in the said case being, Charge-Sheet No. 1222/2025 dated 8th November, 2025 punishable under Sections 376, 417, 420 and 506 of IPC. 3. The present grievance of the petitioner is that although an FIR has been registered and charge- sheet has been submitted by the concerned police station, the accused person in the meantime has been enlarged on bail. The accused person has thereafter threatened the petitioner and his minor son. The petitioner has also lodged a complaint dated 18th November, 2025 with the Officer-in-Charge of Kotwali Police Station bringing on record such threats meted out to the petitioner. 4. In light of the fact that the case has been investigated and the charge-sheet has been submitted, the prayer made in the writ petition has become infructuous. 5. However, this Court notes with concern that the victim lady who would be a witness in the said case has been threatened by the accused person. The Officer-in-Charge of Kotwali Police Station
shall look into the compliant dated 18th November, 2025 filed by the petitioner and checked the veracity thereof.
In the event, the allegations made in the said complaint appear to be true, appropriate steps shall be taken in accordance with law. 6. Accordingly, WPA 21133 of 2025 is disposed of without any order as to costs. 7. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court. 8. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities. ( Anuj Singh, J. )
