No.4909 of 2026 ORDER This Petition is filed to condone the delay of 749 days in filing the above second appeal. 2. The learned counsel for the petitioners would submit that, owing to a lack of communication, the petitioners were unable to keep track of the proceedings, which resulted in a delay of 749 days in filing the present appeal. 3. The learned counsel appearing for the respondent raised a strong objection, contending that the petitioners have failed to satisfactorily explain the reasons for the delay. 4. Considering the fact that the first petitioner is aged about 60 years and to give one more opportunity to the petitioners, this Petition is allowed and the delay of 749 days is condoned on payment of cost of Rs.5,000/- (Rupees Five Thousand only) to the learned counsel for the respondent within two weeks from today. On production of receipt of such payment, the Registry is directed to number the second appeal, if the papers are otherwise in order and list the same for admission on 28.07.2026.
