1. The instant bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the FIR No.58/2025 registered at the Police Station Kotwali Bundi, District Bundi wherein he was charged for the offences punishable under Sections 318(4) and 316(2) of BNS, 2023. 2. Counsel for the petitioner submits that the alleged offences are triable by the Magistrate and so far as the money taken by the petitioner is concerned, the same has been refunded to the complainant. Counsel further submits that the petitioner is in judicial custody since 19.12.2025. Counsel submits that the trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioner. (2 of 2) [CRLMB-1013/2026]
3. Per contra, learned Public Prosecutor opposed the bail application. 4. The complainant has put his appearance in person along with his counsel and submits that he has received a certain amount of money from the petitioner and he has no objection in case indulgence of bail be granted to the petitioner. 5 Heard and considered the submissions made at Bar and perused the material available on record. 6. Considering the arguments put forward by learned counsel for the respective parties and looking to the fact that the amount has been partly given by the petitioner to the complainant and the complainant has no objection in case, the instant application is accepted to his extent and also looking to the fact that the alleged offence is triable by the Magistrate and since the trial will take its own time to conclude, hence without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS. 7.

Accordingly, the instant bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner- Kadir Khan S/o Abdul Gafur Khan arrested in connection with the aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing, as and when called upon to do so.
