The petitioner has been made accused in connection with Spl. POCSO Case No.165 of 2023 arising out of Mandar P.S. Case No.89 of 2023 registered under Section 341, 354, 427, 506 of the Indian Penal Code and Section 8/12 of the POCSO Act. This is the second journey of the petitioner with the prayer for regular bail as earlier the prayer for bail of the petitioner was rejected vide order dated 24.04.2024 passed in B.A. No.2452 of 2024. Learned counsel for the petitioner submits that the fresh ground is that in the meanwhile the petitioner has been in custody for a further period of more than 1½ years. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that five out of six witnesses have already been examined and all of them have supported the case of the prosecution and in view of the overwhelming evidence against the petitioner, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is, therefore, submitted that the petitioner ought not be released on bail at this stage. Considering the serious nature of allegation against the petitioner as well as his chance of absconding and tampering with the evidence and in view of the evidence that has already come from the deposition of five out of six witnesses, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail.
