Civil court vide order dated 11th December, 2003 passed an ex parte decree thereby plaintiffs’ title in respect of 8 annas share measuring 4.57 acre based on purchase deed dated 12th January, 1962 was declared and permanent injunction was 2 granted against defendants in respect of suit property. Suit schedule property is not described in this writ petition, as a result whereof implementation of ex parte order dated 11th December, 2003 appears to be impermissible. Moreover, petitioner being plaintiff in aforesaid suit had the option to put said decree into execution. 3) Hence, present writ petition is not interfered with and same stands dismissed. 4) However, this order shall not preclude petitioner to approach appropriate forum in accordance with law, if so advised. 5) Parties to act on server copy of this order duly downloaded from the official website of this Court.
