protection given by the Government in its Memo.No.480/LAR(2)/787/2 dated 24.08.1987 which says that the condition of applying for appointment within one year from the date of displacement does not apply to whomever were displaced prior to the issuance of the above G.O.Ms.No.98 Irrigation (Proj. Wing) Department dated 15.04.1986 and this context has also been affirmed by the A.P.A.T. in its orders in O.A.No.7917/2003 dated 16.07.2007 and O.A.No.9807/2009 dated 21.08.2009 and Orders in W.P.No.2436 of 2011 dated 08.02.2011 by this Hon'ble Court and in SLP.No.14305 of 2011 dated 04.07.2011 by the Apex Court while appointing others whose dates of displacements were much later to petitioner and his family, as illegal, arbitrary, discriminatory and violation of Articles 14, 21 and 300(A) of the Constitution of India and consequently declare that the petitioner is entitled to be appointed in any suitable post under G.O.Ms.No.98 Irrigation (Proj.
Wing) Department dated 15.04.1986 on the basis of date of displacement regardless of the date of application by taking into consideration of the said orders of the A.P.A.T. in O.A.No.7917/2003 dated 16.07.2007 and O.A.No.9807/2009 dated 21.08.2009 and said Orders in W.P.No.2436 of 2011 dated 08.02.2011 by this Hon'ble Court and in SLP.No.14305 of 2011 dated 04.07.2011 by the Apex Court including judgment in W.P.(AT).No.174/2021 and batch with all consequential benefits and to pass IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent Authorities to consider the case of the petitioner for appointment to any suitable post pursuant to his representation dated 27.11.2012 and by disposing the same through the District Selection Committee thereby fixing a time pending disposal of the above main writ petition and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant leave to these respondents in W.P.No.8309 of 2024 to file Counter Affidavit in the above Writ Petition and pass Counsel for the Petitioner:

The Writ Petition has been filed by the petitioner for the following relief:
“…….to issue order, writ or direction more particularly one in the nature of Writ of Mandamus declaring the impugned action of the Respondent Authorities in not considering the appointment petitioner's claim for under the displaced persons category in terms of G.O.Ms.No.98 Irrigation (Proj. Wing ) Department dated 15-04-1986 by stating that his application is beyond one year as per Award No.29/84 dated 10.11.1984 despite his claim is covered by the protection given by the Government in its Memo.No.480/LAR(2)/787/2 dated 24.08.1987 which says that the condition of applying for appointment within one year from the date of displacement does not apply to whomever were displaced prior to the issuance of the above G.O.Ms.No.98 Irrigation (Proj. 2. Heard Sri Ramesh Babu Tatapudi, learned counsel for the petitioner and Sri S.Sarath Kumar, Learned Assistant Government Pleader for respondents-services-II. 3. The contention of the learned counsel for the petitioner is that the petitioner is the displaced person affected by the Sri Pothuluri Veera

Brahmendra Reservoir (in short, called as SPVBR) of the Telugu Ganga Project. After the displacement of the petitioner, the competent authority issued displacement certificate to the petitioner. 4.
It is further contended that the Government constituted a Committee through G.O.Ms.No.266 of I & CAD to derive the date for fixing the cut-off date for the purpose of receiving applications from the deprived displaced persons, and the date was fixed as 18.09.2006. 5. It is also further contended that they are entitled for employment under G.O.Ms.No.98, Irrigation & CAD Department, dated 15.04.1986, and their names are to be considered by the respondent authorities for placing them in the list of candidates and also for considering their candidature for employment under the said scheme. 6. In similar facts and circumstances, this Court granted relief under various Writ Petitions and Writ Appeals. This Court passed directions to the respondent authorities to consider the case of the petitioner for employment under the scheme provided under G.O.Ms.No.98, Irrigation (Project Wing) Department, dated 15.04.1986, by relaxing the condition of one-year limitation from the date of notification of displacement for filing an application before the competent authority for providing employment. 7.
Learned counsel for the petitioner placed reliance on the judgment of this Court in W.P.No.32923 of 2023, dated 17.03.2026, wherein this Court passed an order directing the respondents to consider the case of the

petitioners for appointment as per G.O.Ms.No.98, Irrigation (Project Wing) Department, dated 15.04.1986, and to pass appropriate orders within a period of three (03) months from the date of receipt of a copy of the said order.

Having considered the submissions of the learned counsel for the petitioner and the learned Assistant Government Pleader for Services-II, and upon perusal of the record as well as the judgment of this Court in W.P.No.32923 of 2023, this Writ Petition is disposed of, directing the respondent authorities to consider the case of the petitioner for appointment as per G.O.Ms.No.98, Irrigation (Project Wing) Department, dated 15.04.1986, and to pass appropriate orders within a period of three (03) months from the date of receipt of a copy of this Court order. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
