W.P.(MD) No.19255 of 2026 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 09.07.2026 CORAM THE HON'BLE MR.JUSTICE C.SARAVANAN W.P.(MD)No.19255 of 2026 C.Pal Eswaran ... Petitioner Vs. 1.The District Registrar (Administration), Madurai South, Madurai District. 2.The Sub Registrar, Peraiyur Sub Registrar Office, Peraiyur, Madurai District. ... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, directing the second respondent to release and return the petitioner's registered Sale Deed in P/Peraiyur/519/2026 registered vide Receipt No.3718/2026 dated 22.06.2026, within a time frame to be fixed by this Court. For Petitioner : Mr.M.Prabhakaran For Respondents : Ms.P.Sudarkodi Natchiyar Government Standing Counsel ORDER The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the second respondent to release the Sale Deed presented for registration on 18.06.2026. _____________ Page No. 1 of 4 https://www.mhc.tn.gov.in/judis W.P.(MD) No.19255 of 2026 2. It appears that the Sale Deed was presented for registration on the said date. However, instead of registering the document or issuing a refusal check slip, the second respondent has kept the document pending for further verification. 3. The learned Standing Counsel appearing for the respondents submitted that the officials attached to the Sub-Registrar Office had conducted a physical inspection of the property and found that there was a proposal to convert the land into housing plots. It is, therefore, submitted that registration of the document would be hit by Section 22-A of the Registration Act, 1908. 4. A prima facie reading of the schedule to the Sale Deed and the description of the property indicates that the petitioner proposes to purchase an extent of 56 cents out of a larger extent of 2.12 acres comprised in Survey No.2/1, Chinnapoolanpatti Village, Peraiyur Taluk. Prima facie, there is nothing to indicate that the document seeks registration of a housing plot or that it attracts the bar under Section 22-A of the Registration Act, 1908. _____________ Page No. 2 of 4 https://www.mhc.tn.gov.in/judis W.P.(MD) No.19255 of 2026 5. Accordingly, the second respondent is directed to process the document and proceed further in accordance with law within a period of one week from the date of receipt of a copy of this order. 6. This Writ Petition stands disposed of accordingly. There shall be no order as to costs.
