The instant bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner in connection with FIR No. 0012/2026 registered at Police Station Transport Nagar (Jaipur City East), District Jaipur City (East) for offence under Sections 8, 21 of the N.D.P.S. Act 1985 and Section 111(2)(b) of B.N.S. Act 2023 and against the order dated 19.03.2026 whereby learned Trial Court dismissed the bail application filed by the accused-petitioner for the offences punishable under Sections 8/21 and 8/29. 2. Heard. [2026:RJ-JP:14089] (2 of 3) [CRLMB-4977/2026] 3. Considered the submissions made by the counsel for the petitioner as well as learned Public Prosecutor and perused the challan papers. 4. The allegation against the accused-petitioner is that she said to have been given the alleged contraband to the co-accused Rohit Sansi from whose possession the contraband was recovered. 5. Learned counsel for the petitioner submits that the accused-petitioner is in custody since 13.03.2026. Counsel also submits that the accused-petitioner is a woman and a kid of aged about one year is also in jail along with her. 6. Learned Public Prosecutor has opposed the bail application. 7. Taking into consideration the overall facts and circumstances of the case and more particularly the fact that the accused-petitioner is a woman and she has been implicated in this case with the aid of Section 8/29 of N.D.P.S. Act and a child aged about one year is with her in the jail, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the accused-petitioner on bail. 8. Accordingly, the present bail application is allowed and it is directed that the accused-petitioner shall be released on bail provided that she furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lax Only) together with two sureties in the sum of Rs.50,000/-(Rupees Fifty Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that she shall appear before that Court or any Court to which the [2026:RJ-JP:14089] (3 of 3) [CRLMB-4977/2026] matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 9. However, it is made clear that in case the accused- petitioner is found to be involved in any other criminal case of similar nature in future, the prosecution would be at liberty to move an application for cancellation of this bail order.
