O.P.(MD) No.12954 of 2026 ORDER The present petition has been filed by the sole accused in Cr.No.33 of 2026, on the file of the 1st respondent police, seeking to quash the FIR, wherein the petitioner is alleged to have committed offenses under Sections 281, 125(a) and 106(1) of BNSS. 2. The defacto complainant have appeared before this Court on 03.07.2026 and she submitted that she does not want to prosecute the criminal case and agreed for quashing of the FIR. 3. Today, an affidavit has been filed to the said effect by the defacto complainant. Paragraph 3, 4 and 5 of the affidavit are extracted as follows:- “3. I submit that after the incident I came to know about the legal consequences. Based on the intimation received by the 2nd respondent through the petitioner and the 2nd respondent had a conversation through the rural adult people's and they said to have a compromise for the welfare of the petitioner, So the petitioner and the 2nd respondent got compromised without any instigation. Hence, as per the terms of Compromise between the parties the 2nd respondent/victim are willing to quit the criminal case as against petitioner. The 2nd respondent/victim has forgotten the incident and ready to put full stop the above criminal case so far, the petitioner concern. 2/4 https://www.mhc.tn.gov.in/judis Crl. O.P.(MD) No.12954 of 2026 4. I submit that hence, as per the terms of Compromise between the parties the 2nd respondent/victim is willing to quit the criminal case as against petitioner. I am forgotten the incident and ready to put full stop the above criminal case so far, the petitioners concern. 5. I submit that I agreed to settle the dispute by entering into this Joint Memo of Compromise voluntarily without any coercion or compulsion as against this petitioner concern. Hence, the case in Cr.No.33/2026 on the file of the 1st Respondent police has to be quashed as far as the petitioner is concern.” 4. In view of the joint compromise memo and the affidavit filed by the defacto complainant, FIR on the file of the 1st responders police stands quashed.
