No.13434 of 2026 ORDER The petitioner is the sole accused in Spl.S.C.No.72 of 2023 on the file of the learned Special Court for the Exclusive Trial of POCSO Act Cases, Dindigul. He was tried for the offences punishable under Section 450 of IPC and Sections 5(l), 5(j)(ii) r/w 6 of POCSO Act. After the trial, the trial Court, by its Judgment dated 29.05.2024, found the petitioner guilty, convicted and sentenced him to undergo five years rigorous imprisonment and to pay a fine of Rs.1,000/-, in default, to undergo three months simple imprisonment, for the offence under Section 450 of IPC and sentenced to undergo 20 years rigorous imprisonment and to pay a fine of Rs.1,000/-, in default, to undergo six months simple imprisonment, for the offence under Section 6 of POCSO Act, 2012. 2.Challenging the Judgment of conviction and sentence, the petitioner has filed an appeal before this Court in Crl.A.(MD)No.111 of 2026, and the same has been admitted on 23.01.2026. No.13434 of 2026 3.The allegation as against the petitioner is that he had a physical relationship with the victim girl, aged about 16 years and made her pregnant. 4.The learned Government Advocate (Crl. side) pointed out that the victim girl delivered a female child. A DNA test was conducted, and the DNA test proved that the petitioner is the biological father of the child. 5.Considering the available material showing that the petitioner had a physical relationship with the victim girl, who was aged about 16 years and made her pregnant, this Court is not inclined to suspend the sentence and release the petitioner on bail.
