Rev.Apl.C.(MD)No.25 of 2026 Prayer: Review Application is filed under Section 114 r/w. Order XLVII of the Civil Procedure Code, to review the order of this Court in W.A.(MD)No.341 of 2024 dated 27.03.2025. For Review Applicants : Mr.M.Kannan, Govt. Advocate. For Respondents : Mr.S.Xavier Rajini for R1 ORDER (Order of the Court was delivered by S.SRIMATHY J.) This review application is filed challenging the order passed in W.A.(MD)No.341 of 2024. The only ground that is raised by the review applicants is that if the order of this Court is implemented, that would open floodgate and that the first respondent herein is not entitled to pensionary benefits. 2.This Court has considered the said issues already in the writ appeal itself. In fact, 50% of the passed service was not allowed to be calculated. The first respondent is entitled to pensionary benefits with effect from 01.03.2003 onwards and therefore, there is no financial burden on the government. The order was passed based on the factual matrix and service particulars of the writ petitioner. Therefore, this case 2/4 https://www.mhc.tn.gov.in/judis
Rev.Apl.C.(MD)No.25 of 2026 cannot be sighted as a precedent for all persons and that therefore the apprehension raised by the government also is not a ground to review the earlier order. 3.The review application is dismissed accordingly. No costs.
