AND J.M.F.C., ADDITIONAL MACT, HARIHARA, PARTLY ALLOWING THE CLAIM PETITION FOR COMPENSATION AND SEEKING ENHANCEMENT OF COMPENSATION.
THIS APPEAL COMING ON FOR ADMISSION THIS DAY,
JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE MRS. JUSTICE P SREE SUDHA ORAL JUDGMENT This appeal is filed by the appellants/claimants under Section 173(1) of Motor Vehicles Act, 1988 challenging the
judgment and award dated 15.04.2024 passed in MVC No.299/2022 on the file of the Senior Civil Judge and J.M.F.C., Additional MACT, Harihara, for enhancing the compensation.
2. Heard the arguments of the learned counsel for the appellants and learned counsel for respondent No.3. The ranks of the parties are retained as per tribunal for the sake of convenience.
3. The petitioners/claimants had filed the claim petition before the tribunal claiming for compensation due to death of one Abdul Nayim son of Mohammed Isak Sab, in a road traffic accident occurred on 12.06.2022. The

Tribunal considering the entire evidence on record granted an amount of Rs.23,18,750/- along with interest at the rate of 6% p.a., from the date of filing of the petition, till the date of realization of award amount, holding respondent Nos.3 and 4 jointly and severally liable to pay the compensation. Aggrieved by the said order, this appeal is filed to enhance the compensation.
4. Learned counsel for the appellants contended that the deceased aged 46 years at the time of accident was doing Mechanic work and was earning income of more than Rs.30,000/- but the tribunal has taken only Rs.15,000/-. Further contended that the amount granted towards loss of consortium is on lower side and also requested to enhance the amount towards funeral expenses and loss of estate.
5.
Learned counsel for respondent/Insurance Company stated the amount granted by the Tribunal under various heads are reasonable, therefore it needs no interference.

6. As there is no proof of income, this court finds it reasonable to consider the notional income of the deceased as Rs.15,500/- per month. Further, as per Ex.P5/post mortem report, the age is considered as 46 years and hence the multiplier applied is 13. Further, 25% is granted towards Future Prospectus of Rs.15,500 X 25% = Rs.3,875/-. Therefore, the sum amount towards the future prospectus is Rs.19,375/- (15,500 + 3,875). Further, due to 4 dependents, 1/4th is to be deducted. Hence, the salary is to be considered as Rs.14,531/- (19,375 - ¼%). Hence, the loss of dependency is Rs.14,531 X 12 X 13 = Rs.22,66,836/-. Further, the consortium is granted at Rs.40,000/- to the dependents which comes to Rs.*44000 X 4 = Rs.176000/- Also, towards funeral expenses an amount of Rs.15,000/- is granted and towards loss of estate an amount of Rs.15,000/- is granted.
7. Thus in all, components awarded by this court are as below, *Corrected vide Court order dt. 25.02.2026
