Item.76 07.10.2026 ssi Ct. 758 WPA 21707 of 2025 Sadhana Ghosh -vs- The State of West Bengal & others. Mr. Arnab Mukherjee Mrs. Madhurima Mukherjee …for the petitioner Mr. Sumanta Das …for the respondent nos. 4, 5 & 7 1. The petitioner had executed a sale deed dated 01.08.2025 transferring a land in admeasuring about 9 sataks at a total consideration of Rs. 10,87,500/-, in favour of the respondent nos. 4 to 6. 2. It is alleged that the private respondents paid a sum of Rs. 4,00,000/- out of the total consideration money, but refused to pay the balance Rs. 6,87,500/- to the petitioner. The petitioner then lodged a complaint with the Krishnaganj Police Station. The said complaint led to registration of Krishnaganj PS Case No. 376 of 2025 dated 11.09.2025 for investigation into the offences punishable under Sections 318 (4)/316(2) of the BNS. 3. Learned Advocate for the petitioner fairly submits that he has already instituted a civil suit for 2 recovery of money against the private respondents. 4. Learned Advocate for the respondents submits that the writ petition is misconceived, and in any event, the prayer made in the writ petition has now become infructuous as the FIR has already been registered. The case is being duly investigated. 5. Learned Advocate for the private respondents further submits that his clients have made payments to the petitioner and nothing remains due. He also submits that this issue is subjudice in the pending civil suit, where the issues will be decided in accordance with law. 6. In view of the fact that the investigation of the case is already going on, no further orders are required to be passed in the present writ petition. 7. In the event, the investigation of the case is not already complete, the I.O. of the case shall take expeditious steps to complete the same and file its report before the Competent Court of Magistrate within a period of three months from date. 8. It is clarified that this Court has not gone into the merits of the rival claims made by the parties. 9. WPA 21707 of 2025 is disposed with the above observations. 10. However, there shall be no order as to costs. (Anuj Singh, J.)
