In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Basirhat Police Station FIR No. 805 of 2024 dated 02.11.2024 under Sections 21(C)/29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 14A(b)/14(C) of the Foreigners Act.

In Re : Babu Gazi ... Petitioner.
Ms. Malashree Ghosh
... For the Petitioner.
Mr. Rajendra Banerjee, APP, Mr. Lokesh Sharma, Mr. Harshit Jaiswal
... For the State.
Learned advocate appearing for the petitioner submits that petitioner is similarly situated as the other accused person who has been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail on the grounds that petitioner is not an Indian national. Having considered the aforesaid fact that the petitioner belongs to Bangladesh and the same is revealed from the records including the factum of recovery in the present case, I am of the opinion that this is not a fit case for releasing the petitioner on bail as he is a foreigner. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record.
2 The application for bail, being CRM (NDPS) 2056 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
