No.12601 of 2026 The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 115(2), 296(b), 303(2), 351(3) & 489(2) of BNS, 2023, Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.607 of 2026 on the file of the respondent police, seeks anticipatory bail. 2. The allegation against the petitioner is that the petitioner joined hands with the other accused, trespassed into the house of the defacto complainant and abused her and her family members in filthy language, and attacked her and also snatched a gold chain from the defacto complainant and her sister. Hence, the case has been registered. 3. When the matter is taken up for hearing, the learned counsel for the petitioner sought time for advancing argument. 4, The learned Government Advocate (Crl. Side) appearing for respondent submitted that on an earlier occasion, at the request made by the learned counsel for the petitioner, the matter was listed today and submitted that properties in this case is not recovered, and investigation 2/4 https://www.mhc.tn.gov.in/judis CRL OP(MD). I have gone through the FIR and also the connected materials and it reveals that the petitioner is the main accused who is not only attacked the defacto complainant and also snatched away the some of the gold jewels. The Accident Register shows that the accused taken away the gold jewels after attacking the defacto complainant and after the occurrence, complaint has been lodged by the defacto complainant after admitting herself in the hospital. 6. In view of the same, since the offence is includes the stealing of property and the alleged property has not yet been recovered, I am not inclined to grant anticipatory bail to the petitioner. 7.
