1. Mr. Abhijay Negi, learned counsel for the petitioners.
2. Mr. D.K. Bankoti, learned Brief Holder for the State of Uttarakhand.
3. Petitioners are engaged through outsource agency in the Forest Department for discharging duties as labourer. According to them, all of them have served for more than ten years, therefore, they have become entitled to dearness allowance in view of judgment rendered by Hon’ble Surpeme Court in Uttaranchal Van Shramik Sangh vs. Om Prakash.
4. By means of this writ petition, petitioners have sought the following relief: -
(i) Issue a writ, order or direction in the nature of mandamus to command the respondent Uttarakhand Forest Department to disburse the Dearness Allowance to the petitioners in consonance with the Government Orders dated 25.11.2021, 09.12.2021, 01.02.2022 (Annexure No. 1 (colly)) and also pay the petitioners arrears with the penal rate of interest.
(ii) Issue a writ, order or direction in the nature of certiorari quashing the government order dated 15.11.2023 (Annexure No. 2) as it is violation with judgment 19.07.2022 of the Hon’ble Supreme Court (Annexure No. 3).
(iii) Issue a writ, order or direction in the nature of mandamus commanding the respondent State Government and Uttarakhand Forest Department to consider the case of the petitioners for regularization in consonance with the division bench judgment of the Hon’ble High
2026:UHC:3538 Court in WPSB No. 616 of 2018 and the Uttarakhand Regularization Rules of
2013. (Annexure no. 8).

Learned counsel for the petitioners submits that petitioners have been making representation(s) from time to time before the Competent Authority, highlighting their grievance, however, no heed is being paid on petitioners’ representation.
6. Learned State Counsel assures the Court that decision, if not already taken, shall be taken as early as possible.
7. The writ petition is, accordingly,
disposed of with liberty to petitioners to make separate fresh representation(s) before the Division Forest Officer concerned. If they make such representation(s) within two weeks, decision thereupon shall be taken, as per law, within four months thereafter.
