For Petitioner : Mr.B.Vinoth Kumar For R1 : Mr.V.B.Sundareshwar, CGSC 1/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.19635 of 2026 ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondent to consider the petitioner's explanation dated 29.12.2025 and to re-issue the passport in favour of the petitioner in respect of the file No.MD1076115259825, dated 11.12.2025 based on the petitioner's explanation dated 29.12.2025. 2.Heard Mr.B.Vinoth Kumar, learned counsel appearing for the petitioner and Mr.V.B.Sundareshwar, learned Standing Counsel, who accepts notice on behalf of the respondent. 3.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself. 4.The learned counsel appearing for the petitioner submitted that the petitioner had obtained a passport in the year 2016. As the said passport has 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.19635 of 2026 expired, the petitioner applied for its renewal. However, the application has not been processed till date. The petitioner submitted an explanation dated 29.12.2025 in support of the renewal application. Since the said explanation has not been considered, the present Writ Petition has been filed. 5.The learned Standing Counsel appearing for the respondent submitted that if the petitioner submits a satisfactory explanation along with the expired passport before the competent authority, the same would be considered on merits and in accordance with the provisions of the Passports Act, 1967 and the Rules framed thereunder. 6.In view of the submissions made by the learned counsel on either side and without expressing any opinion on the merits of the case, this Court directs the petitioner to submit a fresh copy of the explanation, along with the expired passport, before the respondent within two days from the date of receipt of a copy of this order.
