A perusal of the FIR reveals that the petitioner's vehicle said to have been used for transporting sand. The petitioner had filed an application in Crl.M.P.No.95 of 2026 under Sections 438 r/w. 440 of BNSS, before the learned Judicial Magistrate, Valliyoor, Tirunelveli District, seeking return of said vehicle. The said application was dismissed. Challenging the same, the petitioner has preferred Crl.R.C.No. 06 of 2026 before the V Additional District and Sessions Court, Valliyoor, Tirunelveli and the same was also dismissed. A perusal of the orders of the Court reveals that the petitioner's vehicle is involved in a similar case earlier and therefore, the petitioner's request for granting interim custody has been rejected. 4. The learned Counsel for State of TN (Crl.Side) appearing for the respondent submitted that the petitioner's vehicle is involved in three similar previous cases. 5. In view of the above said facts, this Court is of the considered opinion that the petitioner's vehicle is continuously involved in similar offences and therefore, the courts below have rightly rejected the request of the petitioner for interim custody. 6.
