It has been pointed out that the name of the petitioner has been wrongly recorded in the order dated February 16, 2026 wherein the name of the petitioner was wrongly recorded as “Tarapada Ray” instead of “Dr. Tapabrata Ray”. Let such error be rectified. This order shall form part of the order dated February 16, 2026. Considering the urgency involved in this matter this Court directed WPA 26178 of 2024 to be taken up along with WPA 3247 of 2026. Accordingly a supplementary list has been published. 2
Mr. Bhattacharyya, learned advocate appearing for the petitioner in the aforesaid writ petitions submits, on instruction, that the petitioner is ready and willing to appear before the Chief Judicial Magistrate, Calcutta in Maidan P.S. Part-II, case No.3 dated October 15, 2024 on the next date fixed i.e. on February 24, 2026 accompanied by his learned advocate. The learned advocates appearing for the State submit that in the event the petitioner appears before the Chief Judicial Magistrate, Calcutta on that date necessary orders in accordance with law shall be passed on that date. Mr. Bhattacharyya, learned advocate appearing for the petitioner submits that a direction be passed upon the respondent/police authorities to issue the police verification report for the purpose of appointment of the petitioner to the post of General Duty Medical Officer in the West Bengal, ESI Medical Service under the Labour Department, Government of West Bengal. Mr. Ghosh, learned advocate appearing for the State in WPA 2347 of 2026 assures this Court that prompt steps shall be taken to process the application for issuance of police verification report immediately upon passing of the order by the Chief Judicial Magistrate, Calcutta in the aforesaid matter. 3
In the light of the stand taken by the learned advocates for the respective parties, nothing survives to be decided in the aforesaid writ petitions.
Accordingly, WPA 3247 of 2026 and WPA 26178 of 2024 stands disposed of by giving liberty to the petitioner to appear before the Chief Judicial Magistrate, Calcutta in the aforesaid case on February 24, 2026 accompanied by his learned advocate and in the event the petitioner appears on the said date, the Chief Judicial Magistrate, Calcutta is requested to pass necessary order in accordance with law as expeditiously as possible preferably on February 24, 2026 but not later than February 25, 2026 considering the urgency involved in the matter. Immediately upon receipt of a copy of the order, the concerned authority of the Kolkata Police shall process the application for issuance of the police verification report and shall conclude the entire process in accordance with law as expeditiously as possible but positively within 10 working days from the receipt of a copy of the order passed in the aforesaid case by the Chief Judicial Magistrate, Calcutta. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
