This is an appeal preferred against a judgment and decree dated 5 December 2017 passed by the Learned Civil Judge (Senior Division), 10th Court, Alipore, District - 24 Parganas in Title Suit No.23 of 2010. 2. The suit is one for partition. All the parties are members of one Agrawal/Agarwala family. 3. The matter has been repeatedly adjourned. It is submitted on behalf of all the parties that during the pendency of this appeal, the parties had entered into a Terms of Settlement. A copy of the Terms of Settlement alongwith the sketch plan pertaining to the premises no.16/3, Hindustan Road, Kolkata – 700029 be kept with the records. The terms have been duly signed by all the parties. 4. It is submitted on behalf of all the respective Advocates that the Terms of Settlement reflect the true and correct intention of the parties. In view of 2 the Terms of Settlement, nothing survives in this appeal. FA 43 of 2019 stands disposed of. Let the Terms of Settlement be treated as the part of the decree. The impugned decree stands modified in terms of the Terms of Settlement. 5. The Department is directed to take necessary steps for drawing up, completing and finalising the decree as modified by the Terms of Settlement filed in Court.
