Learned counsel for the petitioner submits that the petitioner is in custody since 08.02.2022 in connection with S.T. Case No.201/2022, arising out of Budhai P.S. Case No.04 of 2022 registered under Sections 302 of the Indian Penal Code, now pending in the court of learned Additional Sessions Judge – I, Madhupur (Deoghar). 3. The learned counsel for the petitioner submits that the petitioner is in custody since 08.02.2022 and has been falsely implicated in this case. He submits that trial is hardly progressing in view of the fact that only 2 out of 10 witnesses, have been examined and the last witness was examined only in the month of March 2025. 4. During the course of argument, it transpired that son of the victim had filed the F.I.R. against his father (the present petitioner) alleging that the petitioner had murdered his mother by kudal. 5. The learned counsel for the State is not in a position to explain as to why the witnesses are not being promptly produced before the court. He submits that for that he will have to seek instruction. 6. After hearing the learned counsels for the parties and considering the direct allegation made against the petitioner, this Court is not inclined to enlarge the petitioner on bail. However, non- production of witnesses in the trial is quite serious. 7. The State is directed to ensure that the remaining witnesses are promptly produced before the court. 2026:JHHC:10181 2 8. The learned counsel for the State is directed to communicate this order to the Director, Prosecution and also the Superintendent of Police of the concerned district to ensure compliance. 9.
