GP FOR WOMEN DEV CHILD WELFARE(AP) The Court made the following: 3 VS,J W.P.No.25481 of 2018 ORDER: This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents pending representation the petitioner dated 20.05.2017 issued paper publication dated 02.07.2018 for appointment of Anganwadi Worker in Narayana Nagar, V.Kota Mandal, Chittoor District under BC-A catageory is illegal, arbitrary and violation of principles of natural justice and consequently direct the respondents to continue the petitioner as Anwanwadi worker at Narayan Nagar, V.Kota Mandal, Chittoor District and pass” 2. The petitioner was appointed as anganwadi worker, Narayana nagar, V. Kota mandal, Chittoor district by the respondent authorities vide proceedings dated 02.06.2009. While the matter stood thus, the petitioner was suspended from her service vide proceedings dated 07.12.2009, which were challenged before this Court in W.P.No.23871 of 2010, which was disposed of by this Court on 28.10.2013 by directing the respondent authorities to pass appropriate orders on the allegations leveled against the petitioner after conducting due enquiry and by affording an opportunity to the petitioner. 3. Subsequently, on 20.05.2017, the petitioner submitted a representation to the respondents with a request to conduct an enquiry as directed by this Court. In spite of the same, the respondent authorities 4 VS,J W.P.No.25481 of 2018 issued paper publication dated 02.07.2018 to fill up the post of anganwadi worker in Narayana nagar, V. Kota mandal, Chittoor district under the category of BC-A. Aggrieved by the same, the present writ petition is filed. 4. When the writ petition came up for hearing on 26.07.2018, this Court has passed an interim order directing the respondents not to fill up the vacancy of Anganwadi centre in Narayana Nagar, V. Kota mandal, Chittoor District. 5. Respondent No.4 filed a detailed counter duly stating that, in pursuance of the orders dated 28.10.2013 passed by this Court in W.P.No.23871 of 2010, an enquiry was conducted on 24.01.2014 and a report was submitted stating that the petitioner is not a resident of Narayana Nagar Village, but is residing in Byreddipalli Village and Mandal. Pursuant to the enquiry report, the 3rd respondent – Project Director passed an order on 24.01.2014 stating that the petitioner’s name was not entered in the Narayana Nagar Anganwadi Center Survey register and, thus, the petitioner is not a local candidate as on the date of the application for the post of Anganwadi worker of Narayana Nagar Center. As such, the 3rd respondent rejected the request of the petitioner for re- appointment as Anganwadi Worker vide orders dated 24.01.2014, and the same could not be communicated to the petitioner as she is not 5 VS,J W.P.No.25481 of 2018 available/residing in Narayana Nagar Village. Hence requested to dismiss the writ petition. 6. Heard Sri.C. Prakash, learned counsel for the petitioner and learned Assistant Government Pleader for Women Development and Child Welfare. 7. Perused the entire material available on record. The facts of the writ petition are not in dispute. Pursuant to the directions issued by this Court in W.P.No.23871 of 2010, vide order dated 28.10.2013, the respondent authorities have conducted an enquiry into the matter on 24.01.2014 and after completion of enquiry, the 3rd respondent vide 24.01.2014 held that the petitioner is not a resident of Narayana Nagar, V.Kota mandal, Chittoor and as such, she cannot be re-appointed as anganwadi worker of the said anganwadi centre as the same is against the rules. 8. As the respondent authorities have issued the impugned paper publication dated 02.07.2018 after complying with the orders passed by this Court in W.P.No.23871 of 2010 by duly conducting an enquiry, this Court is of the opinion that no further cause survives in the present writ petition. 9. Accordingly, this writ petition is dismissed.
