Mr. Ramesh Chandra Joshi, Advocate for the State of Uttarakhand. 3. Petitioner is serving as Assistant Teacher, L.T. Grade (Music) in Kumaon Division and she was last posted in Government Girls Inter College, Jainti, Almora. Vide order dated 10.07.2006, she was sent on deputation to State Council for Educational Research and Training (SCERT), Dehradun. Vide order dated 30.06.2024 (wrongly mentioned as 30.07.2024 in the relief clause), petitioner was repatriated from SCERT to Government Girls Inter College, Masi, Almora. Petitioner has challenged the said order in this writ petition. 4. Coordinate Bench passed an interim order in favour of the petitioner on 22.10.2024, on the strength of which, petitioner is still serving at SCERT. 5. Learned State Counsel submits that a deputationist does not have any right of absorption in the borrowing organisation. He submits that petitioner has served for nearly 20 years in SCERT, therefore, there is nothing wrong if she is asked to go back to her parent organisation. 2026:UHC:977 6. Mr. Vikas Pande, learned counsel appearing for the petitioner, however, submits that petitioner is a single parent and she has a school going child, which aspect was highlighted by petitioner in her representation, but, it was completely ignored. He submits that petitioner’s representation was rejected without application of mind. 7. Having regard to the facts and circumstances of the case, this Court thinks that ends of justice would be met, if petitioner is permitted to make fresh representation to the competent authority, highlighting her grievance. 8. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to the competent authority. If she makes representation within ten days from today, decision thereupon shall be taken, as per law, within three weeks thereafter. For a period of five weeks or till decision is taken, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
