The petitioner happens to be the owner of the vehicle. State submits a report reflecting no criminal antecedents of the present petitioner. The petitioner is in custody for more than two years nine months. Having regard to the ground on which other accused person has been granted bail, I am of the opinion that same principle will supply to the present petitioner also. The petitioner be released on the same terms and conditions as was imposed upon Tathagata Roy in CRM (NDPS) 1762 of 2026. 2 Hence, the prayer for bail of the petitioner [Subrata Das] is Allowed. Accordingly, CRM (NDPS) 2090 of 2026 is allowed. Pending application(s), if any, is also disposed of.
