No.3 of 2023 (O.S.No.8747 of 2019) on the file of XV Additional City Civil Court, Chennai. For Petitioner(s): Mr.Gracy Martin Louis (Party-In-Person) For Respondent(s): M/s.Colonel and Ganesan Associates for R4 https://www.mhc.tn.gov.in/judis CRP No. 3948 of 2026 ORDER This civil revision petition has been filed, challenging the impugned order dated 12.01.2024 passed by the XV Additional Judge, City Civil Court, Chennai in I.A. No.3 of 2023. 2. In the aforesaid order, the application filed by the plaintiffs in O.S. No.8747 of 2019, seeking to restore the suit, which was dismissed for default on 11.08.2023, has been allowed. Aggrieved by the same, the petitioner, who is the second defendant in the suit, has filed this civil revision petition. 3. As seen from the impugned order, the suit has been filed by the respondents / plaintiffs for partition. The application seeking to restore the suit, which was dismissed for default, has been filed within time. Detailed reasons have been given in the affidavit filed in support of I.A. No.3 of 2023. The trial court has accepted the said reasons as sufficient cause and has allowed the application filed by the plaintiffs under the impugned order. Instead of contesting the main suit on merits, the petitioner, who is appearing as a party in person has filed this civil revision petition, which is unnecessary. 4. This Court does not find any infirmity in the impugned order. Accordingly, this civil revision petition is dismissed. No costs.
