3. Present bail application is moved by the applicant, who is in judicial custody in connection with FIR No.64 of 2025 under Section 109, 138, 333, 351(3), 87 of Bhartiya Nyaya Sanhita and Section 3/25 of The Arms Act, Police Station Kempty (Sessions Trial No.13 of 2025), District Tehri Garhwal.

Learned counsel for the applicant submits that co-accused Sukhchain has been granted bail by this Court vide order dated 21.04.2026 in the similar offence. He submits that P.W.1-victim, who is the star prosecution witness, has turned hostile. He further submits that on the ground of parity, applicant may be released on bail.
5. Learned State counsel has opposed the bail application.
6. Having considered the overall facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail.
7. Accordingly, bail application is allowed. Let the applicant-Sobir Singh be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
8. Pending application, if any, stands
disposed of.
