D/L.240 Rakib (Rejected) CRM (M) 459 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gaighata Police Station case no. 663 of 2025 dated 02.07.2025 under Sections 336(2)/336(3)/338/339/340/332/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 14A(b) of the Foreigners Act. And In the matter of : Harichand Mondal & Anr. ……Petitioners. Mr. Pabitra Biswas ……for the Petitioners. Ms. Sonali Das Ms. Puja Goswami ……for the State. Learned advocate appearing for the petitioners submits that petitioners are in custody for four months and charge-sheet has already been submitted. It has also been brought to the notice of this Court that petitioners are in possession of documents which could reveal that the petitioner is an Indian Citizen. Learned advocate for the State opposes the prayer for bail and submits that there is a verification through the Ministry of External Affairs which reflects that the address of the present petitioner do tally with the address of Bangladesh. Having considered the materials available in the Case Diary, I am of the view that this is not a fit case for granting bail. Learned trial Court would expedite the process of trial. With the aforesaid observations CRM (M) 459 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
