1. This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No.20/2025 registered at Police Station – Samri Path, District – Balrampur-Ramanujganj (C.G.) for the offence punishable under Section 109(1), 3(5) of the BNS, 2023 and Sections 25, 27 of Arms Act.
2. As per prosecution story, in brief, is that, on 10.05.2025 the complainant nandu Korwa lodged report at Police Station Samripath alleging therein that on 01.02.2025 on the request of son of accused VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.23 17:10:21 +0530
2 Dinwa, the complainant took the wife of Dinwa at kusmi by motorcycle for payment of installment of vehicle and thereafter brought the wife of accused Dinwa from Kusmi to Pipardhaba, due to which, the accused Dinwa doubted that the complainant has illicit relationship with the wife of accused Dinwa. On 09.05.2025 at about 9.00 PM, when the complainant along with Ravindra and Laxman were going to attend marriage function at Village Nawatoli, at that time, the accused Dinwa has fired by Muzzle-loading Gun upon the complainant, due to which, the complainant has received wrist and back side. On the basis of said aid complaint, the FIR was registered against the accused Dinwa.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He further submits that applicant assaulted the injured by the muzzle loading Gun and victim/injured suffered injuries on his wrist and back side. He also submits that the charges framed on 06.02.2026 and co-accused has already been granted bail by this Court and conclusion of the trial may take some time. He further submits that the present applicant is in jail since 11.05.2025, therefore, he prays for grant of regular bail to the present applicant.
4. On the other hand, learned State counsel, opposes the bail application and submits that the injured person sustained gunshot wounds to the wrist and back, and underwent surgery, therefore, the instant bail application filed by the present applicant is liable to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.

6. Considering the facts and circumstances of the case, submissions of
learned counsel for the parties, nature and gravity of the offence and the material available on record, it is evident that injured sustained gunshot wounds to his wrist and back, and underwent surgery and he remained in jail since 11.05.2025, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on bail.

Accordingly, this bail application of applicant – Dinva Nagesiya involved in Crime No.20/2025 registered at Police Station – Samri Path, District – Balrampur-Ramanujganj (C.G.) for the offence punishable under Section 109(1), 3(5) of the BNS, 2023 and Sections 25, 27 of Arms Act, is rejected at this stage.
