For Petitioner(s): Mr.C.Deepakkumar For Respondent(s): Mr.R.Ganesh Kumar Counsel for Government for R1 & R2 ORDER This petition has been filed seeking direction to the 1st and 2nd respondents to provide adequate police protection to carry out the fencing of the my property comprised in Survey No.89/21 to a total extent of 5 Ares at Kolanaiyakanpatti Village, Mettur Taluk, Salem District, which has already been surveyed by the revenue authorities representation dated 20.05.2026. https://www.mhc.tn.gov.in/judis WP Crl. It is seen that the petitioner purchased the property comprised in Survey No.89/21, to a total extent of 5 Acres at Kolanaickenpatti Village, Mettur Taluk, Salem District, by way of a registered sale deed dated 02.06.2025, registered as Document No.2550 of 2025. This being the case, respondents 3 to 6 attempted to interfere with the peaceful possession and enjoyment of the property. Therefore, the petitioner filed a Writ Petition before this Court in W.P. No.30604 of 2025 seeking police protection to survey the land. As directed by this Court, police protection was provided to the surveyor, and the land was surveyed. Now, the petitioner seeks police protection to fence the land. If there is any dispute between the petitioner and respondents 3 to 6 regarding the land, they ought to have approached the Civil Court. 3. The learned Government Advocate, on instructions, would submit that upon the complaint lodged by the petitioner, the 2nd respondent registered an FIR in Crime No.67 of 2026 against the petitioner, and an FIR in Crime No.68 of 2026 against respondents 3 to 6. Both complaints are currently pending investigation. 4. In view of the above, the police protection sought by the petitioner for a civil dispute cannot be considered. The 2nd respondent is directed to complete the investigation and file a final report within twelve weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP Crl.
