rejecting the approval of the appointments of the petitioners in W.P. No.17765/2024 on the ground that the appointments were made without obtaining prior approval from the competent authority. 3. The case of the petitioners in W.P.No.17765/2024 is that the first petitioner–Society in W.P.No.27880/2024 is running an educational institution, namely, Perkala High School. Due to the retirement of teachers in Kannada, Science, Arts, and Mathematics, the posts fell vacant. All these posts were admitted to grant-in-aid. The petitioner- Management was therefore required to seek approval from the authority for filling up the said posts. Accordingly, the Under Secretary, Department of Education, by communication vide Annexure-H dated 21.06.2022, addressed the Commissioner seeking issuance of approval or permission to fill up those posts. 4. Thereafter, the Management conducted interviews in accordance with the rules and appointed the petitioners

in W.P.No.17765/2024. Subsequently, a proposal was submitted vide Annexure-F dated 04.10.2023 seeking approval of the four posts.
However, by the impugned endorsement vide Annexure-G dated 09.10.2023, the proposal was returned on the ground that prior permission had not been obtained from the authority under the Rules framed under the Karnataka Education Act. 5. The learned counsel appearing for the petitioner- Management submits that this Court, in W.P. No.11667/2022, held that educational institutions are only required to inform the competent authority while filling up vacancies arising due to retirement, resignation, promotion, or death in respect of posts admitted to grant- in-aid, and that prior approval from the authority is not required. The operative portion of the order passed by this Court in W.P. No.11667/2022, disposed of on 08.12.2023, is extracted below:
"116. In view of the observations above, the writ petition is allowed and it is hereby held that
