JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 13.06.2024 passed by the learned Single Judge of this Court in W.P.No.24297/2023 (GM/POLICE). 2. In terms of the said order, the writ petition was disposed of with a direction to the concerned respondent authorities to consider and take appropriate steps/actions pursuant to the complaint lodged by the writ petitioner (complainant) which was acknowledged by accused No.1-The Station House Officer, Sampigehalli Police Station on 06.08.2023. 3. It is the case of the accused that even prior to the said order, the complaint of the writ petitioner was considered and it was found that the allegation involved is a civil dispute. Accordingly, - 4 - HC-KAR NC: 2026:KHC:2421-DB CCC No. 602 of 2025 endorsement dated 03.10.2023 was issued. However, the complainant had declined to receive the said endorsement. 4. The said contention is disputed by the learned counsel for the complainant. He submits that the complainant has never received any endorsement at the material time. If the complainant had received the same, she would have taken other steps in accordance with law. 5. Be that as it may. The accused has now issued a fresh endorsement dated 07.01.2026 which refers to the earlier endorsement. The accused has reiterated that the complaint lodged by the complainant has been closed with an advice to approach the concerned competent Civil Court. 6. It is not necessary for this Court to examine the merits of the said endorsement. However, it is clear that the order, the disobedience of which is alleged, has been complied with. In this view, we are unable to accept that any proceedings for wilful disobedience of the order dated 13.06.2024 are required to be initiated. The complaint is accordingly closed. We also clarify that - 5 - HC-KAR NC: 2026:KHC:2421-DB CCC No. 602 of 2025 this order will not preclude the complainant from availing of such remedies as may be advised.
